AN ORDINANCE TO AMEND CHAPTER 29 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, PERTAINING TO UNCLAIMED PROPERTY IN CUSTODY OF <br />POLICE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Article III of Chapter 29 of the Code of <br />the City of Portsmouth, Virginia, 1973, be araended and <br />reordained to read as follows: <br /> <br />ARTICLE III. Unclaimed propert~ <br /> in custody of police <br /> <br />Section 29-31. Definition. <br /> <br /> The term "unclaimed personal property~ shall be any <br />personal property belonging to another which has been acquired <br />by a law enforcement officer pursuant to his duties, which <br />is not neededin any criminal prosecution, which has not <br />been claimed by its rightful owner and which the State <br />Treasurer has indicated will be declined if remitted under <br />the Virginia UniformDisposition of Unclaimed Property Act <br />(Section 55-210.1 et seq.). Bicycles, motor vehicles and <br />their contents, firearms, contraband items,.lost and found <br />items, and currency are not subject to this Article. <br /> <br />Section 29-32. 'Sale of unclaimed property. <br /> <br /> Any unclaimed personal property which has been inthe <br />possessio~ of the Portsmouth Police Department and unclaimed <br />for a period of more than sixty days shall be subject to <br />public s~e. Prior tothe sale of any unclaimed personal <br />property, the Chief of Police or his duly authorized agent <br />shall make reasonable attempts to notify the rightful owner <br />of the property, obtain from the Commonwealth's Attorney in <br />writing a statement advising that the item is not needed in <br />any criminal prosecution, and cause to be published in a <br />newspaper of general circulation in the locality once aweek <br />for two successive weeks, notice that there will be a public <br />Sale of unclaimed personal property. Such property shall be <br />described generally in the notice, together with the date, <br />time and place of the sale. <br /> <br />Section 29-33. Sale of perishable, etc. goods. <br /> <br /> If any goods, wares, merchandise or chattels which are <br />of perishable nature, or which shall be expensive to keep, <br />shall at any time remain unclaimed in the custody of the <br />division of police, the Chief of Police may sell the same <br />at public auction, at such time and after such notice as to <br />him shall seem proper. <br /> <br /> <br />
