(b) A child who is habitually disobedient <br />of the reasonable and lawful commands of his or her parent, <br />guardian, legal custodian or other person standing in loco <br />patently; or <br /> <br /> (c) A child who remains away from or habitually <br />deserts or abandons his or her family; or <br /> <br /> (d) A child who commits an act, which is <br />otherwise lawful, but is designated a crime only if committed <br />by a child. <br /> <br /> Provided, however, to find that a child falls within <br />any of classes, 1, 2 or 3 above (i) the conduct complained <br />of must present a clear and substantial danger to the child's <br />life or health or (ii) the child or his~or her family must <br />be in need of treatment~ rehabilitation Ur services not <br />presently being received~ and (iii) the intervention of the <br />court must be essential %o provide the treatment, rehabilitation <br />or services needed bY the child or his or her family. <br /> <br />(3) DELINQUENT CHILD - means: <br /> <br /> (a) A child who has committ~ a delinquent <br />act, that is, an act designated a crime under the laws of <br />the Commonwealth of Virginia, or an ordinance of any city, <br />county, town or service district, or under federal law, except <br />an act, which is otherwise lawful, but is designated a crime <br />only if committed by a child. <br /> <br /> (b) An adult, who prior to his or her eighteenth <br />birthday, committed a delinquent act as defined by subsection <br /> (B) (3) (a). <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held January 26, t982~ <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
