AN ORDINANCE TO'AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY ADDING TO ARTICLE VI, DIVISION 1 OF <br />CHAPTER 23 THEREOF, SECTION 23-2~9 AND BY DELETING FROM <br />SECTION 23-204(a) PARAGRAPH 12 THEREOF, PERTAINING TO PARKING <br />IN SPACES RESERVED FOR HANDICAPPED PERSONS. <br /> <br /> BE IT ORDAINED by the Coundil of the City of Portsmouth, <br />Virginia: <br /> <br /> !. That Section 23-204(a) of the Code 6f the City of <br />Portsmouth, Virginia~-19~3, be amended by deleting paragraph <br />12 thereof. <br /> <br /> 2. That Article VI, Division t of Chapter 23 of the <br />Code of the City of Portsmouth, Virginia, 1973, be amended <br />by adding thereto Section 23-229 to read as follows: <br /> <br />Section 23-229. Parking in spaces reserved for handicapped <br /> persons. <br /> <br /> It shall be unlawful for a nonhandicapped operator of <br />a motor vehicle to park in a parking space reserved for the <br />handicapped at privately owned shopping centers, business <br />offices, 'or parking lots or on the streets or public grounds <br />of the City~ unless such operator is using the motor vehicle <br />to transport a handicapped person who has obtained a special <br />vehicle parking permit from the division. For purposes of <br />this section, the term "nonhandicapped operator" shall mean <br />the operator of a motor vehicle who has not been issued a <br />'license or decal by the division designating such person as <br />handicapped. The license issued by the division must be <br />displayed in the form of a permanent license plate affixed <br />to the vehicle. The decal issued by the division must be <br />displayed in the front windshield of the motor vehicle when <br />such vehicle is parked in a parking space reserved for the <br />handicapped. <br /> <br /> It shall be the duty of each police officer or other <br /> uniformed employee of the Police Department to give to any <br /> person~operating a motor vehicle parked in violation of <br /> this.ssction a notice, or to attach to the vehicle found <br /> so parked a notice to the owner, that such vehicle has been <br /> illegally parked in violation of this section and instructing <br /> him to report to the Portsmouth Police Department Headouarters. <br /> Each person so notified may within seventy-two (72) hours <br /> from the time when such notice was given or attached to the <br />'vehicle pay the sum of Twenty-Five ($25.00) Dollars due to <br /> this vehicle b~ing illegally oarked in violation of this <br /> <br /> <br />
