AN ORDINANCE CLOSING A CERTAIN 16 FOOT ALLEY ON THE EAST SIDE OF TYRE NECK ROAD. WHEREAS, the Trucker Group, R~ R. Roentgen Associates, and william A. and Edith Copeland,!have made application to vacate, close and discontinue the hereinafter-described por- tion of a certain alley; and WHEREAS, by resolution of this Council adopted December 14, 1982, viewers were appointed pursuant to ~15.1-364, Code of Virginia, 1950, as amended, to view the hereinafter- described portion of said street, and to report in writing whether in their opinion any, and if any, what inconvenience would result from discontinuing said alley; and WHEREAS, the said viewers have reported in writing that in their opinion no inconvenience would result from the closing and discontinuing of said alley; and WEEREAS, the City may require that its streets~ alleys, easements and other public ways be purchased by the persons requesting the vacation of same provided such person or persons are the owner of all land that abuts the public land for which a valuation ±s sought, and provided further that the parties agree as to the value of such property or easement; and WHEREAS, the parties have agreed that the value of such property or easement for the closure of this 16 foot alley is $832.00 the receipt of which is hereby acknowledged. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that the hereinafter-described alley be closed and vacated as a public street or alley. S-82-il Ail that certain 16 foot alley or strip of land situate, lying and being in the City of Portsmouth, Virginia, located to the rear and south of 5ots i through 17, both .inclus±¥e,- in Block 14, and lying north of Lots 18 through 34, both inclusive, in Block 14, Plat of the Property of the Churchland Land Company, which pla~ is recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Map Book 18, Page 85. The said 16 foot alley extends from Tyre Neck Road easterly for a distance of approximately 520 feet to the west right-of-way line of an alley on the Seaboard Coast Line Railroad property.
