misdemeanor and, upon conviction thereof, shall be punished by a fine of not less <br />than two hundred and fifty dollars nor more than five hundred dollars or by con- <br />finement in jail not exceeding six months, or by both such fine and confinement, <br />and each day's business in violation of the provisions of this section shall <br />constitute a separate offense. <br /> <br /> (4) The provisions of this section shall not apply to trustees selling <br />under deeds of assignment, or mortgages, or to sheriffs, constables or other <br />public or court officers, or to any other person acting under the license, direction, <br />or authority of any court, state or federal, selling goods in the course of their <br />official duties. Nor shall the provisions of this section apply to a merchant <br />who has been conducting a business in the city continuously for at least one year <br />immediately prior thereto under an ordinary merchant's license and who is either <br />closing out his stock of goods and advertises as such or disposing of a stock <br />of goods which has been damaged by fire, smoke, water or otherwise and who ad- <br />vertises as such; provided, that any such sale shall not be exempted from the <br />provisions of this section if it is held for a period of more than thirty calendar <br />days, and provided further that a complete inventory of the goods to be sold at <br />any such sale shall be filed with the City Collector prior to commencing or ad- <br />vertising the sale and all pertinent provisions of sub-sections (2) and (3) hereof <br />shall apply to such sales. <br /> <br />This ordinance shall be in effect on and after the first day of May, <br />1958. <br /> <br /> <br />
