WHERFAS, David A. Pritchard, Jro, has filed an application pursuant <br />to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1961, for <br />the granting of a use permit as hereinafter described; and <br /> <br /> WHERF2~S, the applicant, the Planning Director and the City Manager <br />have done all things required to be done in connection with said application, <br />and the Planning Commission has recommended the granting of said use permit, <br />subject to the conditions hereinafter stated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Ports- <br />mouth, Virginia: <br /> <br />Ac That the use for which the use permit hereinafter described is sought <br />(1) will not adversely affect the health or safety of persons re- <br />siding or working in the neighborhood of the proposed use, (2) will <br />not be detrimental to the public welfare or injurious to properly <br />or improvements in the neighborhood, and (3) will be in accord with <br />the purposes of the said Zoning Ordinance. <br /> <br />Bo That David A0 Pritchard, Jr., his heirs, successors and assigns, <br />ms hereby gr~nted a use permit, pursuant to Section 4-2 of said <br />Zoning Ordinance, for the construction,operation and maintenance of <br />four boat slips and ten off-street parking spaces as shown on the <br />amended site plan attached hereto and made a part hereof, near the <br />foot of Constitution Avenue, for a period of twenty (20) years, sub- <br />ject at alt times to revocation by this Council for failure to com- <br />ply with the following conditions deemed necessary to assure that the <br />use permit hereby granted will conform to the requirements of said <br />Zoning Ordinance, and that it will continue to do so: <br /> <br />(1) <br /> <br />That the driveway and parking lot shown on said amended site plan <br />be improved and maintained with respect to pavement, markings, <br />drainage facilities, shrubbery, and bumper guards to the satis- <br />faction of the DireCtor of Public Works; <br /> <br />(2) That outdoor lighting be shielded away from any adjoining residence; <br /> <br />(3) <br /> <br />That Portsmouth public safety officials shall have the specific <br />right a~ any time to enter upon said driveway and parking lot, for <br />purposes of inspections; <br /> <br />(4) <br /> <br />That maintenance and replacement of this bulkhead, finger piers <br />and pilings shall be limited to that shown on the said amended <br />site plan. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a <br />meeting held January 23, 1962. <br /> <br />City Clerk. <br /> <br /> <br />
