WHERFAS, David A. Pritchard, Jro, has filed an application pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and WHERF2~S, the applicant, the Planning Director and the City Manager have done all things required to be done in connection with said application, and the Planning Commission has recommended the granting of said use permit, subject to the conditions hereinafter stated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Ports- mouth, Virginia: Ac That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons re- siding or working in the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to properly or improvements in the neighborhood, and (3) will be in accord with the purposes of the said Zoning Ordinance. Bo That David A0 Pritchard, Jr., his heirs, successors and assigns, ms hereby gr~nted a use permit, pursuant to Section 4-2 of said Zoning Ordinance, for the construction,operation and maintenance of four boat slips and ten off-street parking spaces as shown on the amended site plan attached hereto and made a part hereof, near the foot of Constitution Avenue, for a period of twenty (20) years, sub- ject at alt times to revocation by this Council for failure to com- ply with the following conditions deemed necessary to assure that the use permit hereby granted will conform to the requirements of said Zoning Ordinance, and that it will continue to do so: (1) That the driveway and parking lot shown on said amended site plan be improved and maintained with respect to pavement, markings, drainage facilities, shrubbery, and bumper guards to the satis- faction of the DireCtor of Public Works; (2) That outdoor lighting be shielded away from any adjoining residence; (3) That Portsmouth public safety officials shall have the specific right a~ any time to enter upon said driveway and parking lot, for purposes of inspections; (4) That maintenance and replacement of this bulkhead, finger piers and pilings shall be limited to that shown on the said amended site plan.
