WHEREAS, PorTsmouth Iron and Metal Company, Inco, has filed an <br />application pursuant to Section 4-2 of the Zoning Ordinance of the <br />City of Portsmouth, 1981~ for the granting of a use permit as herein- <br />after described; and <br /> <br /> WHERFAS, the applicant, the Planning Director and the <br />have done all things required to be done in connection with <br />and the Planning Commission has recommended the granting of <br /> <br />City ~;~nager <br />said application, <br />said use permit° <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />That the use for which the use permit hereinafter <br />described is sought ~1) will not ~dversely affect the <br />health or safety of persons residing or working in the <br />neighborhood of the proposed use~ (2) will not be <br />detrimental to the public welfare or injurious to property <br />or improvements in the neighborhood, aha (3) will be in <br />accord with the purposes of said Zoning Ordinance° <br /> <br />Bo That the use permit hereinafter granted shall be subject <br /> to the following conditions: <br /> <br /> Io That the applicant comply with the provisions of <br /> Section 4-3(150) of the Zoning Ordinance° <br />2. ~nat the street side of the premises be landscaped <br /> with shrubbery° <br /> That all open fires on the premises are prohibited and <br /> all burning must b¢ confined to incinerators approved <br /> by the Portsmouth Fire Department° <br /> <br />That Portsmouth Iron and Metal Company, Inc~. is hereby <br />granted a use permit, pursuant to Section 4-B of said <br />Zoning Ordinance, for the construction and operation of <br />a junk and wrecking yard to be located on the property <br />described as follows: Beginning approx. 150' W of the ~ corner <br />of Turnpike Road and Confederate Avenue at the W right-of-way <br />line of an alley, thence N along said line approx, ~40', thence <br />W approxo 1~7' ~o the E right-of-way line of the Norfolk & <br />Portsmouth Belt Line Railroad, thence S along said line <br />apprOXo 4B5' to the N right-of-way line of Turnpike Road, <br />thence NE along said right-of-way line 1~8' to the point <br />of beginning; also, beginning on the S right-of-way line <br />of Turnpike Road ~36o8~ SW of Spruce Street, thence along <br />said line 150', thence SE approx~ 140' to a rear lot line, <br />thence NE along said line 150' to a side lot line, thence <br />NW approx. 125' to the point of beglnning. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at <br />a meeting held July 23, 1963o <br /> <br />Teste: <br /> <br />CITY CLERK <br /> <br /> <br />
