A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN <br />PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER <br />EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 OF <br />THE ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING NECES- <br />SARY FOR THE CONSTRUCTION OF A PARK TO BE LOCATED BE- <br />TWEEN FAYETTE AND SIXTH ST~EETIS IN THE CITY OF PORTSMOUTH. <br /> <br /> Wt{EREAS, the City ot POrtsmouth has found it <br />necessary to acquire the i~te~est hereinafter specified <br />in and to the hereinafter ~es~ribed parcel Of land sit- <br />uate in the City of Portsmouth, Virginia, for the purpose <br />of constructing a nelghbor~oo~ park; and <br /> <br /> WHEREAS, the Cit~ of Portsmouth has not been able <br />to purchase the property desc~ibe~ herein, necessary to <br />the project, because the owners thereof and the City have <br />not been able to agree upo~ t~e price to be paid therefor, <br />or the City has not been a~le~to locate certain of the <br />owners or because of the statds of the title of the pro- <br />perty.; and <br /> <br /> WHEREAS, advance~en~ of the work and use of said <br />project will be delayed unreasonably if the said property <br />is not made available as soon~as possible. <br /> <br /> NOW, THEREFORE, OLVED by the Council of <br />the City of Portsmouth, Vi <br /> <br /> 1. The City is directed to institute <br />eminent domain ~ ying special counsel for <br />that purpose if he deems visable, against the following <br />property situate in the ortsmouth, for the purpose <br />of acquiring fee simple ti , together with any and <br />all easements of access, or air incident to the lan~s <br />of the landowner abuttin( said property, in accordance <br />with and pursuant to Secti 6, 2.07 and 2.08 of the <br />Charter of the City of Pox (Chapter 471 of the Acts <br />of Assembly of i970), and it to the credit of the <br />court as provided by law um hereafter specified to com- <br />pensate William J. Wrig] Marie E. Uright, the owners <br />of the hereinafter descrik roperty. <br /> <br /> 2, The property to be acquired hereunder is des- <br />cribed as: <br /> <br /> Ail that certain lot of land with its <br />appurtenances, situate in the City of Ports- <br />mouth, Virginia. and bounded and described <br />as follows, to-~it: <br /> <br /> <br />
