This agreement made this i2th day of April 1965, between the ~ATLANTIC COAST LINE RAILROAD COMPAg~ and the CITY OF PORTSMOUTH, VIRGINIA, providing for installation of automatic flashing light highway crossing signals in Portsmouth at the following locations: Carolina Avenue, approx. 234~ East of MP B-233, estimated cost $11,544o Lamper Road on N&C Branch, approx 2134' West of MP B-232, estimated cost $12,626o 1o It is mutually agreed by and between the Atlantic Coast Line Railroad Company, a corporation organized and existing under and by virtue of the laws of the State of Virginia, hereinafter styled the Railroad Company, and the City of Portsmouth, Virginia, hereinafter styled the City, that the two acting jointly, propose to protect the crossings of Carolina Avenue and Lamper Road, with automatic flashing light signals. 2o The Railroad Company has prepared plans, estimates, arco, and will purchase necessary materials and perform all work in connection with said installations. The total estimated cost of these two installations is $24~170.~ which will be borne 50% by the Railroad Company, and 50% by the City of Ports- mouth, Virginia° Payment will be made by the'City to the Railroad Company for its cost upon completion and submission of final billo 3o The Railroad Company shall, after completion of the installations, have control of such signals and they shall be operated and maintained by and at the expense of the Railroad Company° 4° It is understood and agreed that this agreement shall not be bind- ing until it has been ratified by a proper ordinance or resolution of the City Council of Portsmouth, Virginia, a certified copy of which resolution or ordi- nance is attached hereto and made a part of this agreement.
