~EAS, pu~su~nv to Public Law 89-117, the United States of <br />America has authorized the ~ir~ of grants to public bodies to aid in <br />financi~ the construction of basic ~ater ~nd sewer projects; and <br /> <br /> ~m~REAS, in compliance with section 402 of the Housing and Urbs~ <br />Development Act of 1965, it is necessary for the City of Portsmouth to <br />declare its la~..d acquisition policy in support of its application for <br />such a grant: <br /> <br /> NOW, ~4ER~-~ORJE, BE IT RESOL~ by the Council of the City of <br />Ports~uth, Virginia, that it is hereby declared that all land necessary <br />for the project which is the subjec~ of the application for a grant under <br />Public Law 89-117, will be acquired in accordance with the following <br />procedures: <br /> <br /> 1. The City will make every reasonable effort to acquire the <br />real property by negotiated purchase before instituting eminent do~ain <br />proceedings. <br /> <br /> 2. The City will not require any owner to surrender possession <br />of real property until it pays, or causes to be paid, to the o~er, (a) <br />the agreed purchase price arrived'at by negotiation, or (b) in any case <br />where oniy the ~me~ut of the payment to the owner is in dispute, not tess <br />than 75 per cent of the appraised fair ~alue as approved by the City and <br />concarred in by the Departvaen~ of Housing and Urban Development. <br /> <br /> ~. ~ne City will not require tony person lawfully occ'~ying prop- <br /> erty to surrender possession without at least 90 days' written notice <br /> from the City of the date on which possession ~11 be required. <br /> <br /> <br />
