F to Letter 74o, NF-I WHEREAS Section 703 of the Housing and Urban Developpent Act of 1965 authorizes the making of grants of Federal funds to any local public body or agency to assist in financing the development cost of neighborhood facilities necessary for carrying out programs of co.unity service~ and WHEREAS the City of Portsmouth (here~n sometimes referred to as "Applicant") deems it to be necessary and in the public interest to provide certain facilities of the type contemplated in said Section 703 and to undertake a project (hereinafter called the :'~eighborhoo~ Facilities Projec?) with Federal grant assistance, described as Old Ci~z Armory; and ~'~HEREAS it is recognized that the Federal contract for such financial~assistance pursuant to said Section 703 wilt impose certain obligations and responsibilities u~on the Applicant and will require snare o, .the among other things (1) tnt provision of the local " ~ ' ~os,. of the Neighborhood Facilities Project, (2) assurances that families or inc~ividuals displaced as a re~u~ of the peve:opm:nt of the Ne~ghbornood Facilities Project will be o~,ered de~,t,so~, and sanitary housin~ within their means, (3) the ma~.~pg of relocation payments in accordance with the regulations pT ~,,e D~partment of Housing and Urban Development, (4) compliance with Fed6rat labor standards, and (5) comgliance with Federal requiremen-cs relating to equal emplo2%ent opportunity; and .b,,:REAS Title VI o¢ the Civil Rights Act of t964, ~nd th~ reoulations of the Department of Housing and Urban Development effectuating that Title provide that no person shall, on ~h~ ground oF race color, or national origin, be excluded from participation in, ce denied the benefits of~ er be subject to discrimination in ~n_ unu~,~aK,, and carrying out of proj ~ " ~ ~ ~ r - e~s receiving Federal Tlnanc.al ass,s~an~e. NOW, T~ER:FORE, THE COUNCIL OF TNF CITY OF PORTSi'~OUTH R_SO~¢cS: 1. That an application on behalf of the City of Portsmouth be made to the Department of Housing and Urban Development for a grant under Section 703 of the Housing and Urban Development Act of 1965~ in an amount e~ual to two=thirds of the development cost of the Neighborhood Facilities Project~ such development cost ne~ estimated to be $128~747.00. 2. That the Neighborhood Facilities Project (a) is necessary for carrying out a program of heal th, recreational, social, or similar community service ~n the area~ (b) is consistent with comprehensive planning for the development of the community and (c) will be available for use by a significant n~mber of the area's io~ or moderate income residents~ 3. That A.P. Johnson, 6r., City Ranager, is hereby authorized and directed to execute and file su~-h application, to execute s~ch contract or contracts as may be necessary fo? the grant applied for, to ~rovide such information and furnish such documents as ~ay b'e required by the Dapartment of Housing and Urban Devet o~ment, and to act as the authorized representative ef the A~p!ican~ in the accomciishment of the Neighborhood Facilities Project.
