RES~, the City of Portsmouth has found it necesssmy to ac- <br />quire the interests hereir~fter s.~cified ~n ar~i to the hereinafter des- <br />cribed parcels of land situate in the City of Portsmouth for the purpose <br />of extending the aforesaid Elm Lane; and <br /> <br /> -~H~&S, the City of Portsmouth. has not been able ~o parchase <br /> the property described herein because the o~rners thereof and the city have <br /> not been able to sgree upon tlne price to be paid therefor;snd <br /> <br /> '~fHERE~£~ the advancement of the extension and the constr~lction <br /> thereof will be ur~easorably delayed if the said property is not made avail- <br /> able as soon as possible. <br /> <br /> N~, TH~FORE~ BE IT RESOLVED by the Council of the City of Ports- <br /> mouth, Vi~ginia: <br /> <br /> Section 1. The City Attorney is directed, to institute eminent <br /> damain proaeedirgs~ amployir~s special counsel for tlnat purpose if he de~ns <br /> it advisable~ a_~ainst the parcels of property hereinafter described for tlne <br /> purpose of acquirirg fee s~mple title therein, in accordance with and p,o~- <br /> suant to Section 23(F) of the ~na~ter of the City of Portsmouth (Clnapter <br /> 229 of the-Acts of Assembly of 1966) and to deposit to the credit of the <br /> court as provided by law the s,s~ hereinafter specified to cempensate tlne <br /> respective o~.naers of the property. <br /> <br /> <br />
