WHEREAS, Wayne L. Crawfor~ has filed an application pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsnmuth, 1961, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant, the Planning Director and the City Manager have done all thir~gs required to be done in connection with said application, 't mud the Planning Commission has recommended the granting of said use permz subject to the conditions hereinafter stated~ NOW, THEREFORE~ BE ~T R~SOLVED by the Council of- the City of Portsmouth, Virgini~f A. That the use for which the use per~it hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use, (2)~ will not be det- rimental to the p. ublic welfare or injurious to property or improvaments ~n the neighborhood, 'and (3) will be in accord with the purposes of said Zoning Ordinance. B. That the use permit hereinafter granted shall he sub- Ject to the following conditions: There shall be no Mobil Oil Sfgn erected upon the property other than at the northwest corner thereof in the location specified in the site plsn. There shall be no banners, streamers, whirling devices, strings of lights or devices of similar nature used upon the property and any lease entered into with respect to the property shall contain provisions prohibiting such use. 3. The facility shall he constructed in such a manner that it ~rlll not interferewith the Effir~uam Street improvament program of the City of Portsmouth. 4. There shall be no secondar~j use of the property beyond that specified in the site plan and any lease entered into With respect to the property shall con- tain provisions prohibiting such use. 5. Seeded areas shall be carefully landscaped so as to create and maintain an attractive facility. That Wayne L. Cravgord, is hereby granted a use permit, pursuant to Section 4-2 of said Zohing Ordinance, for the construction and operation of a gasoline service station to be located on the property described as follows: Begin- ning at the southwest corner of Effir~m and Scott Streets; thence south approxJ_mately 230 feet to the north right of way line of Duke Street; thence west approximately 180 feet to the said line to a point; thence north approximately 230 feet to the south right of way line of Scott Street; thence eaat along said line approximately 180 feet to the point of origin.
