A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF AN <br />AUTOMOII-VE SERVICE STATION AT THE COF~NER OF %fES'±~/~ BRANCH <br />BOULEVARD AND ROD.~N AVE~//E, UP 68-19 <br /> <br /> WHEREAS~ C. E. Nix & Son, Inc. by Bryant G. Nix, Pr~sid.ent, <br /> <br />an application pursuant to Item (24), Section ~-~ of the Zoning Ordinance <br />of the City of Portsmouth, 196t, For the granting of a use permit as here- <br />lnafter described; and <br /> <br /> WHEREAS, the applicant, the Planning Director and the City <br />Manager have done all things required to be done in connection w~th said <br />application, and the Planning Commission has recon~ended the granting of <br />said use permit, subject to the conditions hereinafter stated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter <br /> described is sought (1) will not adversely affect <br /> the health or safety of persons residing or work- <br /> lng in the neighborhood of the proposed use, (2) <br /> will not be detrimental to the public welfare or <br /> injurious to property or improvements in the <br /> neighborhood, and (~) will be in accord with <br /> the purposes of said Zooing Ordinance. <br /> <br /> B. That C. E. Nix & Son, Inc. is hereby granted a <br /> use permit, subject to site plan restrictions, <br /> pursuant to Item (24), Section ~-~ of said <br /> Zoning Ordinance, for the reopenLng and operation <br /> of an existing automotive service station located <br /> <br /> <br />
