A RESOLD~flON TO PROVIDE FOR Tkll ACQUISITION OF CERTAIN PROPF~eTY BY TiM CITY OF PORTSi.©D'!FH T~R 229 OF Ti~ ACTS OF A~E~L~ OF 1966~ SA~ PROP~ BELWG N~ESS~RY FOR T~ CON~RUO~I~?~ ~'~EN~G ~ ~'~RO%~ OF ~TA~ HIGher'AY RO~ 58 ~i;l T~ i}~S~TION OF AB~s BO~ ~ I~GH 8P~ TO T~ I~ECTION 0F ~N~N ~ EP~GN~I 8~S. %,~aEAS, Ln cooperation with the Federal and State goveF~saents, State High~ay Route 58 is being constructed~ widened ~n_d improved from the intersection of Airli~e Boulevard and Hig~ Street to the intersection of london and Effing~aam Streets in the City of Portsmouth, Virginia~ and WBZR~S, psrt of ssid high~ey has been designated as a ~ted Access Highway in accordance with the provisions of Article ~, Chapter Title 33~ of the 1950 Code of V2~ginia as emended~ and ~.f~KLPJL~S, one of the obligations of the City of Portsmouth with respect to said project is the provision of the larJ necessary for the construction; and WHEREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereZnafter specifigd in and to the hereinafter des- cribed papcel of land situate in the City of Portsmouth, Virginia~ for the purpose of constF~cting~ widening and improving the aforesaid State High- way Route 58; and WHEREAS, the City of Poresmou~n has not been able to purchase the property described herein, necessary to the project, because of the status of the title of the property; and ~FHERE~S, advancement of the work and use of ssld State Higheey Route 58 v~-ll be delayed unreasonably if the said property is not made available as soon as possible. NOW, T~PI~P~SFO.RE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: Section 1. The City Attorney is directed to institute enRnent domain proceedings, employing special coomsel for that purpose if he deems it advisable, against the property hereinafter described located along Sts~e Highway Route 58, for the purpose of acquiring fee si~rele title and a temeorary construction easemenv therein, together ~ith any and all easemenvs of access, li~nt, or ~ incident to the lands of the land- owner abutti~ upon said Lim~ited Access Highway and/or upon any of its r~ps, loops, or connections a~ ar~ with intersecting higbm~ays, in ac- cordance with ~ed pursus_nt vo Section 23 (F) of the ChsPter of the City of Portsmouth (Chapter 229 of the Acts of AssemDly of 1966), and to de- posit to the credit of the ceo-rm~ as provided by law the sum hereinafter
