A RESOLUT_TON TO PROVIDE FOR ~HE AC~JISITION OF CERTA~ PROPERTy BY THE CI~F~ OF PO~PSM0b~H bT~ER L~£ DOP~tLN PROCEEDINGS PgRSU~h[f TO CHAP- TEN 229 OF ~ ACTS OF ASSF2~LY 0P 1966~ SAID PROPERTY BEING I'~CESSARY ~DR T~Z CONSTRUO~_iOk~ ~DE~_~[G ~2~D L~ROV~'~%~ 0F STA~ NIG~AY ROUTE ~8 }~OM ~ I~±'m~SECTION OF A]2qLI~ BOU~_~VfaRD ~D HIGH S~ TO ~ !LrlW-Y~ECTION OF LONDON A~D EFFING~2'~ STREETS. ~i~REAS, in cooperation with the Federal and State goverr~nents, State Highway Route 58 is being cons~ructed~ ~%dened and improved from the intersection of Airline Boulevard and Hi~a Street to the intersection of London ~nd Effmngaam Streets in the ~ity of Portsmouth, Virginia; and ~REAS: part of said highway has been des_gnated~ as a Limited Access Hig~away in acoordance with the provisions of Article 3, Chapter 1, Title 33, of the 1950 Code of Virginia as ~mended; and ~AS, one of the obligations of the City of Por~smou. th ~ith respect to said project is the provision of the land necessary for the construction; sand ~g~EREAS, the City of Portsmouth has found it to be necessary to acquire the interests hereinafter seecified in and to the herein~ter described parcel of l~ad situave in th~ City of Por~smouth, Virgi.~ia~ for the purpose of constr~.ct~ag, ~.~de. ning and Zmproving the aforesaid Sta~e Highway Route 58; and Wh~REAS, the City of Portsmouth has not been able to purchase the property described herein, necessary ye the project, because of the status of the title of the property; and }Y~ adv~acement of the work and use of said State Highway Route 58 will be delayed unreasonably iS the said property is not made available as soon as possible. N~[, ~HERE~OBE, 8E IT RESOLVED by the Council o£ the City of Port smouth, Virginia ~ Section 1. ~ne City Attorne~ is directed to institute eminent do~in proceedir~s, en~loying special ~ounsel for that purpose if he ~eems it advisable, against the propervy hereinafter described located along State Highway Route ~8, for the purpose of acquiring a temporary eon- ~structi°n- · ~ easement therein, together with~ any and ail easements of access, ~mgn~ or air incident to the lands of the land~,mer abuttin~ upon said Limited Access ~ghway ~nd/or upon ~ny of its ramps, loops, or connections at and ~th intersecv~_ng hi~h~,~ys, in accordsance ~,~th and pursus~nt to Sec- tion 23 (F) of the Char~er of the City of Port~mouth (Chapter 229 of the Acts of Assen~bly of 1.966)~ and to deposit to the credit of the court as
