A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF C~21RTAIN PROP~ BY ~Pi~ Cl~fY OF PORT~IOb~ bi~R ~?Ji~,P_ DOMaiN PR~INGS P~ TO C~- ~R 229 OF ~ ACrS OP ~S~LY 0P 1966, S~ PROP~Y BE~'~G ~CESS~RY ~R ~ CONS~UCTION, W~{~{G ~ ~'~R0%~ OF STA~ HIG~AY R0~ 58 ~,~ ~ I~ION OF A~ ~b~ ~ HIGH S~f T0 ~ ~TION OF ~N ~ ~P~{G!~M S~ETS. ~m~AS, in cooperation with the Federal and State governments~ - State Highway Route 58 is being constructed, widened and improved from the intersection of Airline Boulevard and High Street to the intersection of London and E~fingham Streets in the City of Portsmouth, Vi~inia; ~nd WHEREAS, part of said highway hss been designated as a Limited Access High%~ey in accordance with the provisions of Article 3, Chapter 1, Title 33, of the 1950 Code of Virginia' as smended} and B~K~%EAS, one of the obligations of the City of Portsmouth ~%th respect to said project is the provision of the land necesssPy for the construction; and ~REAS, the City of Portsmouth has fo~.nd it to be necessary to acquire the interests hereinafter specifiSd in and to the hereinafter described parcel of land situate in the'City of Portsmouth, Virginia, for the p~rpose of constructing, v~idening and improving the aforesaid State High~y Route 58; and V~V~EAS, the City of Portsmouth has not been able to ourchase the property described herein, necessary to the project, becaus~ of the status of the title of the property; and WHEREAS, advancemen~ of the work and use of said State Highway Route 58 will be delayed unreasonal ly if the said prope~y is not made available as soon as possible. NOW, ~ORE, BE IT RESOLVE~ by the Council of the City of Ports~outh, Virginia: Section 1. ?ne City Attorney is directed to institute eminent domain proceedings, anlploying special counsel for that purpose if he deem~ it advisable, against the proper~y hereinafver described located alor6 State Hi~]way Route 58, for the purpose of acquiring fee s~p!e title therein, together ~,%th any and all easements of access, li~ht~ or air - incident to the lands of the lando~mer abutting upon said I~mited Access High~y and/or upon s_ny of its r~mps, loops, or connections at mad ~th ~ntersecting hi~ways~ ~n accordance with and psrsuant to S~ction 23 (~) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of As- sem61y of 1966), and to deposit to the credit of the court as provided by
