A RESOLUTION TO PROVEDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PO~TSiiOU~H UNDER ~'tYJ~'E~ff ~O~,'~IN PROCE,~Oi~qGS PURSU~iV2 TO CHAPTER 229 OF THE AOTS OF /~SS~,IBLY OF 1966~ SAID PROPERTY BEING NECFESS/~Ry FOR THE CONS~tUCTIOJ, t~D~ING/~VD YJV~°ROV~ OF STATE HIGIT~Ay ROU~E 58 FROM THE INTE~.SECTION OF AIPdLINE BOUIm~v'AHD /~ND HIGH STREET TO THE I~ERSECTION OF LO~YDON AND EFFIN~{_~ STP~TS. WHEREAS, in cooperation with the Federa2 and State goverf~ments, State Y~ighway Route 58 is being constrmcted, widened and improved from the intersection of Airline Boulevard and High Street to the intersec- tion of London and Effingham Streets in the City of Portsmouth, Virginia; and WHEREAS, part of said highway has been designated as a Limited A~cess Highway in accordance wi~h the provisions of Article 3, Chapter 1, Title 33~ of the 1950 Code of Virginia as amended; and WHERKAS, one of the obligations of the City of Portsmouth with respect to said project is the provision of the land necessary for the construction; and WHEREAS~ the City of Portsmouth has found it to be necessary to acquire the interests hereinafter specified in and to the hereinafter described parcel of land situate in theC'~mW of Portsmouth, Virginia, for the purpose of constructing~ widening and ~mproving the aforesaid State t~ighway Route 58; and WHERFJ~, the City of Portsmouth'has not been able to purchase the property described herein~ necessary to the project, because of the status of the title of the property; and 'WHERK~S, advancement of the work and use of said State Righ~y Route 58 will be delayed ~reasonably if the said property is not made available as soon as possible. NOW, ~ORE, BE iT RESOLVED by the Cotmcil of the City of Portsmouth, Virginia: Section 1. The City Attorney is directed to institute eminent domain proceedi~gs, e~oloy~mg special counsel for that purpose if he deems it ad'~isable, against the oroperty hereinafter described located along State Highway Route 58, fo~ the pttrpose of acquiring fee simple title therein, together with any a_n~ all easements of access, light, or air incident to the lands of the lsmdo~ met abutting upo~ said Lf~mited Access Iiighway and/or upon a_ny of its ran~,ps, loops, or connectiom~ at and ~th intersecting highways, in accordance ~,~,~ith and pursuant to Section 23 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of As- sembly of 19~), and to deposit to the credit of the cottrt as orovided by law the stem hereinafter soecified to e~. ensate the o~mers of ~he parcel of land, as sho,~n on thos~ certain pleuns-entitled Project 0058-124-102,
