A ~SOLb~fION TO PROVIDE FOR ~qE ACQUISITION DF CERTA~M PROPERTY BY ~ CITY OF POP~i~SMOUT~ O~ER ~'~N~ ~ PR~GS Pb~SU~ TOC~R~ 229 OF T~ ACTS OF ASSembLY OF 1966~ SA~ PRO_~Y~ BE~]~ ?~CESS~Y FOR ~ CON~UCTiON~ W~EN~G ~2~ ~ROI~ OF STA~ HIG~Ay ROO~ 58 ~ECTZON OF ~,~ ~ ~FING~2~ S~S. ~HEREAS, in cooperation with the Federal and Stave governments, State Highwa~ Roo. te 58 is being co~stz~cted, ~.~&dened and improved from the intersection of Airline Boulex~ard and High Street to the intersection or London and Effing~&m Streevs in the City of Portsmouth, Virginia; and ~£HE~EAS, part of sa~d highway has been designated as a L~mited Access Hig~away in accords_nce mlth the provisions of Article 3, Chapter 1, Title 33, of the 1950 Code of Virgl~a as ~mended~ and ~E~s~ one of the obligations of the City of Por~osmouth ~,~th respect to said project is the provision of the land necessary ~or the construction; and WHerEAS, the City of Poroamouth has fo~and it to be necessary to acquire the interests hereinafter specified in and to the hereinafter described psrcel of land situate in the $ity of Portsmouth, Virgi~ia, for the purpose of constructinB, widening and ~mproving the aforesaid State Hi,away Route 58; and ~dEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because of the status of the title of the property; and W~LREAS, advs~ncement of the work and use of said State Highway Route 58 will be delayed ur~easonably if the said proper~y is not made available as soon as possible. NOW, THEREFORE, BE IT R~ESOL~D by the Coomcil of the City of Portsmouth, Virgimia: Section 1. The City Attorney is directed to i~stitu~e eminent domain proceedings, emp!oy~_ng special co~unsel for that purpose if he deem~ it advisable, against the property hereinafter described located along State HigJnway Route 58, for the purpose of acquirimg fee s~mple title therein, together with smy s~nd all easements of access, li~at, or air incident to the la~nds of the lando:~a~er abuvt~ng upon said Limited Access High, may ~_nd/or upon ar~ of its ra.~ps, loops, or cor~nections at and with intersecting hi~aways, in accordance with and pur. suant to Section 23 (F) of the Char~ero ~ of the City of Portsmouth (Chapter 229 of the Acts of As- sembly of 1~6o), and ye deposit to the credit of the cou~t as provided by law the s~m hereinafter specified to co~ensa~e ~ ~ ' = ~h~ o~.~ners of ~he parcel of land, as sho~a on those cert~_.m, pla=ns e ' · - - nvmtlea Project 0058-124-102,
