RESOLUTIO~ REQUESTING THE GENERAL ASSEmbLY <br />OF VIRGINIA TO GRANT TO THE CITY OF PORTS- <br />MOUTH A NEW CHARTER. <br /> <br /> WHEREAS~ Sections 15.1-835 and 15.1-912 of the Code <br />of Virginia, 1950, as amended, provides for the granting of <br />a new city charter upon the holding of a public hearing and <br />request of the city council to the General Assembly; and <br /> <br /> WHEREAS, the city council is of the opinion that it <br />is both necessary and desirable that a new charter be granted <br />to the City of Portsmouth; and <br /> <br /> WHEBEAS, on the ninth day of December, 1969, the city <br />council did hold a public hearing as required by law, on a pro- <br />posed new charter. <br /> <br /> NOW, THERE]FORE BE IT RESOLVED by the Council of the <br />City of Portsraouth, Virginia, that the City Attorney is hereby <br />directed to prepare and transmit to the General Assembly to- <br />gether with certified copies of this resoiution~ a draft of a <br />bill ~epealing the present charter and providing a new charter <br />for'the City of Portsmouth, which new charter shall be substan- <br />tially as hereinafter set forth. <br /> <br />ARTICLE I <br /> <br /> Incorporation mud Bo~mdaries <br /> <br />§ 1.01. Incorporation. ~ <br /> <br /> The inhabitants of the territory comprised withim the <br />limits of the City of Portsmouth, as the same now or may here- <br />after be established, by law, shall continue to be a body politic <br />and corporate under the name of the City of Portsmouth an5 as <br />such shall have perpetual succession~ may sue and be sued, con- <br />tract and be contracted with and may have a corporate seal which <br />it may alter, renew, or amend at its pleasure. <br /> <br />§ !.02. Boundaries. <br /> <br /> The boundaries of the city shall be as described in <br />Chapter 265, Acts of Assembly, 1958; as modified by Chapter 370~ <br />Acts of Assembly, 189~; by an order of the Circuit Court of Nor- <br />folk County entered-November 21, 1908, in its Common Law Order <br />Book 21, page ~67; by an order of the Supreme Court of Appeals <br />confirming an order of the Circuit Court of Norfolk County en- <br />tered June 26, 19t8~ which said order of the Supreme Court of <br />Appeals is recorded in the Circuit Court of Norfolk County in <br />Com~mon Law Order Book 27, page 141; by an order of .~e%sCircuit <br />Court of the City of Portsmouth entered Septembe~['2~;A~S3~ in <br /> <br /> <br />
