45. A RESOLUTION G,~.ItING A UaE PE~qiT FOR THE O,~RA.,iO~ OF AN AUtOMOtiVE SE,,Vi~E STATION AT THE SOUTHEAST INTERSECTION OF AIRLINE AND 'PORTSMOUTH-BOULEVARDS. WHEREAS~ L, R. Whitlow has ma. de application pursuaHt to Section 4-2 of the Z6ning Ordinanoe of the City of Portsmou'th~ 1~61~ for the granting Of a use permit as hereinafter described; and WHEREAS: ~he applicant and the Planning Director have done all things required to be done in connection w~th said application, and the Planning Com- mission has recommended the granting of said use permit, subject to the condi- tions hereinafter stated. NOW, THEREFO~E~ BE IT RESOLVED by the Council of the City of Portsmouth: Virginia: A. ~hat the use ior which the use permit hereinafter described is sought (1) will not adversely affect the health or safety ef persons residing or working in the neighborhood of the proposed use: (2) will not be detrimental to the public welfare or injurious to proper~y or improvements in the neighbor- hood, a~d (3) will be in accord with the purposes of sa4d Zoning Ordinance. B. That L. R. Whitlow is hereby granted a use permit: subject to site plan restrictions~ pursuant to Section 4-2 of the said Zoning Ordinance: for the operation of an automotive service station located on the property described as follows: Beginning at a point on the southeast intersection of Airline and Portsmouth Boulevards; thence running north~ east 29i feet; thence running southeast 230.45 feet to Portsmouth Boulevard; thence running parallel to said Portsmouth Boulevard southwest 154.45 feet; thence con- tinuing parallel to Portsmouth Bouievar~ along a radius 8~.54 feet; thence northwest 42.90 fees to the point of origin.
