A RESOLUTION RATIFYING ASSES~iN~S AGAINST ABO'iTiNG LAND- OWNERS FOR THE CONSTRUCTION OF SID~JAI~ ALONG THE ~ST SIDE OF THE 2400 BLOCE OF PYErF~0NT AVENUE, I~ERE STAh~ARD SIDE~;ALKS DID NOT EXIST. ~P~F~, by Resolution adopted July 8, 1969, the construction ~f sidewalks as hereL~J'ter set forth w~s authorized, ar~ the City Asses- sor was directed to appo~ion the cost thereof between the City of Ports- mouth and the abutting lar~o~aaers, as provided by Iaw; ~nd ~I~JiS, there has been recorded an abstract of the aforesaid Resolution shovoLng the estimated amoo_nt that would be assessed against each ~lando~er; and WHEREAS, the City ~.~r~ger h~s reported to the Council that said side~lks have been cm~leted and t~t the City Assessor has mad~ assessments ~portioning the cost thereof, as set forth in the state- merit thereof attached hereto, which appear to be fair ~nd just and not in excess of the peculiar benefits resulting thereform to abutting land- .o~ers; a~d ~EP~EAS, he b~s ~ther advised that a hearing was held pur- suant to notice on M~rch 18, 1970, at I0:00 A.M., of which all abutting landowners were duIy notified. NOW, TH~RDRE, BE IT~RESOL~by the Council of th~-City of Portsmouth: Section 1: ~t the apportionment and assessment by the City Assess6r against the abuttim4 tando~mers of the sum of $418.00, as set forth Ln the statmment thereof attached hereto mhd made a part hereof, for the construction of side,~lk~ along the west side of the 2400 Block of Piedmont Avenue, Lots 12 tb_~o~. 19, inclusive, in Block No. 37~ ~fnere sts~ndsrd sidewalks did not exist, are hereby approved, ratified ~_nd co~n~irmed~ the s~me not bei~ in excess of the peculiar benefits resulting therefrom to the abuttLng !saado~mers. Section 2: ?o~t said mmo~o_nts assessed against said abut~Lng~' ~ landowners sb~ll b~ payable in five ~ equa_ mmn~! installments, beg~n~g 1970, ~ith ~nterest at six per cent~ per ar~nk~ from said date, pz~ded ~'~ ~- ~ ~j~ ~t~ent may be paid before due. Section 3: ~at the respective est£~ated ~mooa~ts assessed against said abuttir~ lando?aers, if heretofore recorded, are hereby authorized to be ~n~nded of record by the City Clerk to show the final ~mounts assessed against said abutting lando~nqers, as set forth in the aforesaid statement, ~mich _~-r~l a%~o~nts sb~l! ~n no event exceed said estimated e~moo~ts.
