91 A-RESOLUTION GRANTING A USE PEPJIIT TO OPERATE A JUt~q< YA~RD WEST OF IDA BARBOUR HO~LES. . ~ .. ~UHEREAS, Curtis Coan has made an application pur- suant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as here- inafter described; and WHEREAS; the applicant and the Planning Director have done all things required to be done in connection with said application, and the Planning Commission ha~ recommended the-granting of said use permit, subject to the conditions hereinafter stated. NOW, THEP~FORE, BE IT RESOLVEDBY THE COUNCIL OF THE CITY OF PORTSMOUTH, ~IRGINLA: A. That the use for whicb the use permit hereinL after described is sought (1)will not adversely affect the health or safety of. persons residing or working in the neigh- borhood o~ the proposed use, (2) will not be detrimental to the public welfare or injuriou~ to property or improvements in-the neighborhood, and (3) will be im accord with the pur- poses~of said Zoning Ordinance. B. That Cua~tis Coanis hereoy· granted a use e p rmlu to operate a junk yard subject ho the following conditions: (t) That the portion of Rutter Street presently extending fro~ the western right of way line of Peninsula Avenue (paper street] to the western fence line of Curtis Coan i~tal Co.. be ctosed,~ · (2) That open burning as prohibited by Section 4-4 (b) of the Zoning= Ordinance of the City of Portsmouth and Rule 4~I of the Rules of the State Air Pollution Control Board not be conducted, and ~) That the area described belows be permanently enctosed by a fence or wall of 6 feet in height and of 5 percent solidity, pursuant to Section 4-2 of said Zonlng Ordinance on the pro- perry described as follows:
