A RESOLUTION GRANTING A USE PE~IT FOR THE <br />CONSTRUCTION AND OPERATION OF A COMMERCIAL <br />RADIO MAST AND ASSOCIATED TRANSMISSION FACI- <br />LITIES LOCATED ON I2%NDS HEREINAFTER DESCRIBED. <br />UP 71-7. <br /> <br />43 <br /> <br /> WHEREAS, Suffolk Broadcasting Corporation has made ap- <br />plication pursuant to Section 4-2 of the Zoning Ordinance of <br />the City of Portsmouth, 1961, for the granting of a use permit <br />as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said ap- <br />plication, and the Planning Commission has considered the grant- <br />ing of said use permit, subject to the conditions hereinafter <br />stated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter <br />described is sought (1) will not adversely affect the health or <br />safety of persons residing or working in the neighborhood of the <br />proposed use, (2) will not be detrimental to the'public welfare <br />or injurious to property or improvements in the neighborhood, <br />and (3) will be in accord with the purposes of said Zoning <br />Ordinance. <br /> <br /> B. That Suffolk, Broadcasting Corporation, is hereby <br />granted a use permit, subject to ~ederal regulations, pursuant <br />to Section 4-2 of said Zoning Ordinance for the construction <br />and opera~ion of a commercial radio mast and associated trans- <br />mission facilities located|on the property described as follows: <br /> <br />A parcel of land rectangular in shape and ap- <br />proximately 460 feet by 395 feet; one side of <br />which abuts the Twin Pines Subdivision for 460 <br />feet and one side of which abuts the rear of <br />Lots 323-329, both inclusive of the Merrifields <br />Subdivision, for 395 feet; and the other two <br />sides will abut vacant land owned by Harry L. <br />Trotman, Jr., et als; together with a perpetual <br />right of ingress and egress to reach said rec- <br />tangular parcel over and along a strip of land <br />50 feet in width extending from the existing <br />deadend of Greenbrook Drive in a northerly <br />direction and abutting the rear of Lots 330- <br />329 of the Merrifields Subdivision. <br /> <br /> <br />
