36 <br /> <br />RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT RELEASING <br />CERTAIN UTILITY EASEMENTS ON COTTON STREET AND STE?[ART AVELUE. <br /> <br /> [[HEREAS, this Council by ordinance adopted on [.[ay 23, <br />1961, did close and vacate the hereinafter described streets; <br />and <br /> <br /> WiiEREAS, by said ordinancer this Council did reserve <br />unto the City of Portsmouth a perpetual easement within the <br />right of way of the hereinafter described streets for the <br />purpose of maintaining, operating and replacing any and all <br />public utility lines within said streets; and <br /> <br /> WHEREAS, no such utility lines presently exist within <br />the rmght of way of said streets; and <br /> <br /> WHEREAS, the retention of such a perpetual easement <br />is no longer necessary nor of use to the City of Portsmouth; <br /> <br /> NOW, THEREFORE, BE I5 RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and he <br />hereby, is authorized to execute a Deed of Release as is attach- <br />ed hereto which said Deed of Helease will abbrogate said per- <br />petual easemen~ as was reserved under the aforesaid ordinanee <br />and as presently exists within the right of way of the follow- <br />mng streets: <br /> <br />(1) <br /> <br />Cotton Street, between Hill Avenue and <br />Stewart Avenue (sometimes known as <br />Stewart Street). <br /> <br />(2) <br /> <br />Stewart Avenue (sometimes known as <br />Stewart Street), between Wesley Street <br />and Detroit Street. <br /> <br /> Adopted by the Council of the City of Portsmouth, Vir- <br />ginia, at a meeting held August 10, 1971. <br /> <br />City Clerk <br /> <br /> <br />
