A RESOLUTION TO RATIFY AND CONFIRM THE EXECUTION OF AN AGREEMENT BY THE CiTY MANAGER AND THE CITY CLERK WITH THE U. S. NAVY FOR THE USE OF CERTAIN PROPERTY AT CRANEY ISLAND AS A SANITARY LANDFILL AND TO AUTHORIZE THE CITY MANAGER AND THE CITY CLERK TO EXECUTE SUCH DOCUMENTS AS MAY BE NECESSARY WiTH U. So ARMY CORPS OF ENGINEERS TO GAiN ACCESS TO THE NAVY SITE. WHEREAS~ the City Manager and the City Clerk have heretofore executed on baha!f of the city a certain document with the Uo S. Navy~ identified as License Agreement NF (R) 10068; and WHEREAS, the agreement made available to the city land for use as a sanitary landfill; and WHEREAS, such landfill is desporate!y needed for the health~ safety and welfare of the Citizens of Portsmouth; and rights to Engineers; WHEREAS~ it is also necessary to acquire access the landfill site from the Uo S. Army Corps of NOW~ THEREFORE~ HE IT RESOLVED by the Council of the City of Portsmouth~ Virginia: 1. That all actions of the City Manager done in connection with the negotiation of License Agreement NE (R)-10068 by the City Manager is hereby confirmed and ratified. The execution of the said agreement on behalf of the City of Portsmouth by the City Manager is hereby confirmed and rat- ified. The action of the City Clerk in affixing the seal of the City to said agreement and attesting thereto is here- by confirmed and ratified. 2. That the City Manager is hereby given full power and authority to enter in~o negotiations and to execute such docu- ments on behalf of the City as may be necessary to acquire access to the landfill site from the U. S. Army Corps of En- gineers. The City Clerk is authorized to affix the seal of the City to any such documents and to attest thereto. 3. This resolution shall be in effsc~ from its passage.
