A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF AN AUTOMOTIVE SERVICE STATION AT TEE NORTHEAST IN?ERSECTION OF HIGH STREET ?~ST AND TYRE NECK ROAD. WHEREAS, Humble Oil & Refining Company, has made application pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application, and the Planning Commission has considered the granting of said use permit, subject to the conditions hereinafter stated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: A. That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood, and (3) will be in accord with the purposes of said Zoning Ordinance. B. That Humble Oil & Refining Company, is hereby granted a use permit subject to site plan restrictions, pur- suant to Section 4-2 of said Zoning Ordinance for the operation of an Automotive Service Station located on the property des- cribed as follows: BEGINNING at the northeast intersection of High Street West and Tyre Neck Road; thence north along the eastern right-of-way of Tyre Neck Road approximately 150' to a point; thence east approximately 175' to a side property line; thence south along said line approximately i50'.to the northern right-of-way line of High Street West; thence wes~ along said right-of-way line approximately 175' to the point of origin.
