Road, on a line parallel to the centerline of Bar- racks Road, to the point of intersection.of the last said eastern right-of-way line and a prolonga- tion of the northern right-of-way line of a. drive- way encircling Building No. 277; thence southwest- erly along the said northern right-of-way line to the northeast corner of a vehicular parking area situate on the west side of Building No. 277; thence S 79~34~20" W~ 20 feet to a point; thence S t0°25' 40' E, 223' + to a point in the southern boundary line of the ~erein described land, said southbound- ary line being parallel to and 2215.96 feet south of ~he southern right-of-way line of said Norfolk and Western Railway Company; thence S 79Q34'20~ W. 410' + to a point in the western boundary line of the h~rein described !and; thence N 10~25'40" W, 2215.96 feet to the point of beginning; containing 35 acres, more or less, as shewn on Atlantic Divi- sion, Naval Facilities Engineering C~mmand D~g. No. SK-RE-346-72, entitled 'gU. S..Na%~t Weapons Station, Yorktown, Virginia~ St. Juliens Creek Annex, Ports- m~ath~ Virginia, Disposal Map, 35 Acre +0 dated 3 November 1972, attache~ to Report of Ex~ess Real Property, hoiding agency no. 11-72 as Exhibit ~EREAS, the City of Portsmouth, Virginia, needsand'wi!! utilize said property in perpetuity for a public park or recreation area as set forth in its application and in accordance with the re- q~airements of said Act and the rules and regulations promulgated thereunder. NOW~ THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth~ Virginia~ that the City Manager shall make applica- tion to the Secretary of the Interior for and secure the transfer to it of the abovementioned property for said use upon and subject to such exceptions, reservations, terms~ covenants, agreements, conditions and restrictions as the Secretary of the Interior, or his authorized representative, may require in connection with the disposal of said property under said Act and the rules and regu- lations issued pursuant thereto. BE IT FURTHER P~SOLVED that.the City of Portsmouth, Vir- ginia~ has legal authority, is willing and is in a position to as- sume immediate care and maintenance of ~e property, and that A. P. Johnson, Jr., City Manager, be and he hereby is authorized for and on behalf of the City of Portsmouth, Virginia, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the.preparing, making~ and -2-
