~5 A P~ESOLUTiON GRANTING A USE PERMIT FOR THE CONSTRUCTION AND OPER~TiON OF A SE~?~GE PUMPING STATION ON WOODSIDE LANE (UP-74-S) ~ ?~qEREAS~ the Associated Churchtand Investors had- made an application pursuann to Section 40-67 of the Code of the City of Portsmouth Virginia~ i973~ = ~ - ~ ~o~ the granting of a use permit as hereinafter described; and WHER~_~_S~ the applicant and the Planning Director have done all things required to be done in connection with said appiication, and the Planning Commission has recommended the granting of said use permit. NOW~ THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: A. That the use for which the use permit hereinafter described is sought (I) wilt not adversely affec't the health or safety of persons residing or working in the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood~ and (3) will be in accor~ with the purposes of the Zoning Chapter of the City Code. B. That Associated Churchland investors is hereby granted a use permit~ subject to site plan restrictions~ pursuant to Section of the City Code for the construction operation of a sewage pmmping station located on the property described as follows: Beginning on the south right of way line of Woodside Lane approximately 535 feet west of the southwest corner of Southampton Arch and Woodside Lane; thence southwest approxi- mately 170 feet~ thence northwest approxi~ matety 50 feet; thence northeast approximate- ly 50 feet~ thence southeast approxim~teiy 35 feet; thence northeast approximately i20 feet to ~¥oodside Lane; thence southeast !5 feet to the point of crigin~ ~opted by the Council of the City of Portsmouth~ Vir- ginia, at a meeting held June 1t, t974~ City Clerk
