A RESOLUTION TO ~ROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY TF~E CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY OF~ 1970, SAID PROPERTY BEING NHCESSARY FOR THE CONSTRUCTION OF A FIRE STATION BOUNDED ON THE WEST BY LEE AVENUE, ON THE EAST BY INDUSTRIAL AVENUE AND ON THE SOUTH BY CLEVELAND STREET IN THE CITY OF PORTSMOUTH. WHEREAS, the.City of Portsmouth has found it neces- sary to acquire the interest hereinafter specified in and to the hereinafter described parcel of land situate in the City of ~Ortsmouth, Virginia, for the purpose of constructing a Fire Station; and WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because the owners thereof and the City have not been able to agree upon the price to be paid therefor, or the City has not been able to locate certain of the owners or because of the status of the title of the property; and WHEREAS~ advancement of the work and use of said project will be delayed unreasonably if the said property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. The City Attorney is directed to.institute emi- nent domain proceedings, employing special counse~ for that purpose if he deems it advisable, against the following property situate in the City of Portsmouth, for the purpose cf acquiring fee simple title therein, together with any and all easements of access, light or air incident to the lands of the landowner ab~tting upon said property, in accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Ports- mouth (Chapter 471 of the Acts of Assembly of 1970), and to de- posit to the credit of the court as provided by law the sum here- after specified to compensate Henry Kirn, Henry Kirn, Jr.~ ~{oss W. Armistead, Jr., Executor and Trustee of the estate of Henry Kirn, Rufus Kirn, Ellen P. Kirn, Moss W. Armistead, Jr., Mo~s W. Armistead, Executor of the estate of Rufus Kirn, Harry M. Cohen, Irvin H. Cohen and Sidney W. Cohen, Louis Cohen, Receiver for Wool & Company, Incorporated, D. Todd Wool, Esthe~ Woo~, John E. Wool and Joseph C. Wool, or if any of the above named defendants be not living, then their ~eirs or devisees together
