A RESOLUTION TO PROVIDE FOR T~ ACQUISITIO~ OF CERTAIN PROPER~f BY THE CITY OF PORTS~{OUTt~, VIRGINIA, UNDER EMINENT DOM_AN PRO- CEEDINGS PURSUA~JT TO C}T~APTER 471 OF ~ ACTS OF ASSEMBLY OF 1970, SAID PROPERTY BEING NECESSARY FOR TP~ CONSTRUCTION OF A FIRE STATION BOUNDED ON T}~ WEST BY LEE AUENUE, ON THE EAST BY INDUSTRIAL.AVENUE AND ON T~E SOUTH BY CLEVEI~AND STREET IN T~E CITY OF PORTSMOUTH. WHEREAS, the City of Portsmouth has found it neces- sary to acquire the interest hereinafter specified in and to the hereinafter described parcel of land situate in the City of Portsmouth, Virginia, for the purpose of constructing a Fire Station; and WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because the owners thereof and the City. have not been able to agree upon the price to be paid therefor, or the City has not been able to locate certain of the owners or because of the status of the title of the property; and WHEREAS, advancement of the work and use of said project will be delayed unreasonably if the said property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of City of Portsmouth, Virginia: 1. The City Attorney is directed to institute emi- ~nent domain proceedings, employing special counsel for that purpose if he deems it advisable, against the following property situate in the City of Portsmouth, for the purpose of acquiring fee simple title therein, together with any and all easements of access, light or air incident to the lands of the landowner abutting upon said property, in accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Ports- mouth (Chapter 471 of the~,~cts of Assembly of 1970), and to de- posit to the credit of the court as provided by law the sum here- after specified to compensate Carrie Lee McQueen and Georgianna M~Queen a/k/a Georgianna 5~cQueen Jones, or if any of the above named defendants be not living, then their heirs or devisees to- gether with any and all other persons~ kno%rn or unknown, who may have an interest, right, title or claim in and to the property sought to be condemned, ~ho are the o%~ers or who have an inter- est therein of the hereinafter described property.
