A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER F2~!INENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO C~LAPTER 471 OF T~ ACTS OF ASSEMBLY OF <br />1970, SAID PROPERTY BEING NECESS~_RY FOR T~ CONSTRUCTION OF A <br />FIRE STATION BOUNDED ON THE ~EST BY LEE AVES-rUE, ON THE EAST <br />BY INDUSTRIAL AVE~.~q3E AND ON THE SOUTH BY CLEVELA~D STREET IN <br />THE CITY OF PORTSMOUTH. <br /> <br /> W~EREAS, the City of Portsmouth has found it neces- <br />sary'to acquire the interest hereinafter specified in and to <br />the hereinafter described parcel of land situate in the City <br />of Portsmouth, Virginia, for the purpose of constructing a <br />Fire Station; and <br /> <br /> W~EREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the project, <br />because the owners thereof and the City have not-been able to <br />agree upon the price to be paid therefor, or the City has not <br />been able to locate certain of the owners or because of the <br />status of the title of the property; and <br /> <br /> ~4EREAS, advancement of the work and use of said pro- <br />ject will be delayed unreasonably if the said property is not <br />made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute emi- <br />nent domain proceedings, employing special counsel for that <br />purpose if he deems it advisable, against the following property <br />situate in the City. of Portsmouth, for the purpose of acquiring <br />fee simple title therein~ together with any and all easements <br />of access, light or air incident to the lands of the landowner <br />abutting upon said property, in accordance with and pursuant to <br />Sections 2.06, 2.07 and 2.08 of the Charter of the City of Ports- <br />~uth (Chapter 471 of the Acts of Asse~ly of 1970), and to de- <br />posi~ to the credit of the court as provided by law ~he sum here- <br />aft~_r specified to compensate Henry McDowelI, Reva McDowel, a/k/a <br />Reva McDowell, a/k/a Rena McDowetl, Georgianna McQueen Jones, <br />a/k/a/ Georgianna McQueen, Ctora E. Bellamy, Elizabeth McAllister, <br />Claudia Bell Howard, Lula Mae Brown and Ca!lie R. McRae, or if <br />any of the above named defendants be not living, then their heirs <br />or devisees to~ether with any and all other persons, known or un- <br />known, who may-have an int~rest,~right, title or cla~ in an~ to <br />the property sought to be condemned, who are the owners or ~no <br />have an interest therein Of the hereinafter described property. <br /> <br /> <br />
