39 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO OPERATE A ~ARINA ON <br />CERTAIN PROPERTY SITUATE ON THE WESTERN BRANCH OF THE <br />ELIZABETH RIVER IN THE PORT NORFOLK SECTION OF THE CITY. <br /> <br /> WHEREAS, William A~ and Willie May Culpepper <br />have made application pursuant to Section 40-73(b) of the <br />Code of the City of Portsmouth, Virginia, 1973, for the <br />granting of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director <br />have done all things required to be done in connection with <br />said application, and the Planning Commission has recommended <br />the granting of said use permit on condition. <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED by the Council <br />of the City of Portsmouth, Virginia: <br /> <br /> (a) That the use for which the use permit herein- <br />after described is sought (1) will not adversely affect the <br />health or safety of persons presiding or working in the <br />neighborhood of the proposed use, (2) will not be detrimental <br />to the public welfare or injurious to property or improvements <br />in the neighborhood, and (3) will be in accord with the pur- <br />poses of the Zoning Chapter of the City Code~ <br /> <br /> (b) The City of Portsmouth is hereby granting a <br />use permit pursuant to Section 40-73[b) of the City Code to <br />operate a marina on the property described as follows: <br /> <br /> Beginning approximately 180 feet west <br />of the southwest corner of Adams Street and <br />Robinhood Avenue; thence southerly approxi- <br />mately 460 feet to a line of the Western <br />Branch of the Elizabeth River; thence West <br />approximately 120 feet tO a point; thence <br />Northerly approximately 470 feet to the <br />south right of way line of Adams Street; <br />thence east along said right of way approxi- <br />mately 120 feet to the point of origin. <br /> <br /> (c) The granting of this use permit is subject <br />to the following conditions: <br /> <br /> The applicants have one (1) year in which to pre- <br />pare a site plan and have them approved by the Planning <br />Commission and the City Council. If such site plans are not <br />approved within one (1) year, this use permit is void. <br /> <br />Adopted by the Council of the City of Portsmouth, <br /> <br /> <br />
