124 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CILAPTER 471 OF TRE ACTS OF ASSEMELY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTERATION AI~ WIDENING OF SYER ROAD. <br /> <br /> WHEREAS, the City of Portsmouth has foun~ it necessary <br />to acquire the interests hereinafter specified in and to the <br />hereinafter described parcel of land situate in the City of Ports- <br />mouth, Virginia, for the purpose of constructing, altering and <br />widening Syer Road; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the project, <br />because of a defect in the title to the property in that the pre- <br />sent record owners of the property cannot be located; and <br /> <br /> WHEREAS, advancement of the work and use of said pro- <br />ject will be delayed unreasonably if said property is not made <br />available to the City as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Attorney is direct- <br />ed to institute eminent domain proceedings against the following <br />described property situate in the City of Portsmouthr Virginia, <br />for the purpose of acquiring fee simple title thereto, together <br />with any and all easements of access, light or air incident to <br />the lands of the landowner abutting upon said property, in ac- <br />cordance with and pursuant to Sections 2.06, 2.07 and 2.08 of <br />the Charter of the City of Portsmouth (Chapter 471 of the Acts <br />of Assembly of 1970 as amended) t and to deposit to the Clerk of <br />the Circuit Court of the City of Portsmouth as provided by law <br />the sum hereinafter specified to compensate the owner of the <br />parcel of land described as follows: <br /> <br /> Beginning at a point on the northern right <br />of way of Syer Street, said point being South <br />61~01'00'' West 100.15 feet from the northwest- <br />ern intersection of Syer Road with Syer Street; <br />thence continuing along the northern right of <br />way of Syer Street South 61~01~00- West 19.85 <br />feet to a point on the eastern property line <br />of the property now or forme~iy o%.~ed by the <br />City of Portsmouth School Board; thence along <br />the aforesaid City of Portsmouth School BOard <br />property line North 13~26,~9,, West 107.34 feet <br />to a point; thence North 59o47~52., East 30.19 <br /> <br /> <br />
