A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF PARADISE CREEK DRAINAGE PROJECT. WHEREAS, the City of Portsmouth has found it nec- essary to acqumre interests hereinafter specified.~n and to the hereinafter described parcel of land situate mn the City of Portsmouth, Virginia, for the purpose of constructing, altering and maintaining the Paradise Creek Drainage Project. WHEREAS, the City of Portsmouth has not been able to purchase property described herein, necessary to the pro- ject, because the owners thereof in the City have not been able to agree upon price to be paid therefor; and WHEREAS, advancement of the work and use of the said project will be delayed unreasonably if said property is not made available as soon as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. The City Attorney is directed to institute eminent domain proceedings against the following property situated in the City of Portsmouth, for the purpose of ac- quiring fee simple title therein, together with any and all easements of access, light or air incident to the lands of the tando~.~ner abutting upon said property, in accordance and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assenhbly of 1970, as amended), and to depOsit to the credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the owners of the parcel of land designated on that certain plat entitled, "Plat Showing Property To Be Acquired Prom James E. Moring And Dana W. Moring", a copy of said plat is attached hereto. 2. The name of the property owner is.'- James E. Moring And Dana W. Moring.
