93TM A RESOLUTION TO P~OVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DO.MAIM PRO- CEEDINGS PURSUANT TO CH~3TER 471 OP THE ACTS OF ASSEmbLY, AS A~NDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF PARADISE CREE~ DRAINAGE PROJECT. WHEREAS, the City of Portsmouth has found it nec- essary to acquire interests hereinafter specified in and to Me hereinafter described parcel of land situate in the City of Portsmouth, Virginia, for the purpose of constructing, altering and maintaining the Paradise Creek Drainage Project WHEREAS, the City of Portsmouth has not been able to purchase property described herein, necessary to the pro- ject, because the owners thereof in the City have not been able to agree upon price to be paid therefor; and WHEREAS, advancement of the ~¢ork and use of the said project will be delayed unreasonably if said property is not made available as soon as possible. NOW, THEREFORE, BE IT P~SOLVED by the Council of the City of Portsmouth, Virginia: 1. The City Attorney is directed to institute eminent domain proceedings against the following property situated in the City of Portsmouth, for the purpose of ac- quiring fee simple title therein, together with any and all easements of access, light or air incident to the lands of the landowner abutting upon said property, in accordance and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the ov~ers of the parcel of land designated on that certain plat entitled, "Plat Showing Property To Be Acquired From Cradock Sheet Metal and Roofing Company", a copy of said plat is_a~taCh~d hereto. 2.
