?1 <br /> <br />A RESOLUTION GRA~NTING A USE PER~4IT TO OPERATE AN AUTO~4OTIVE <br />SERVICE STATION ON PROPERTY SITUATE ON THE SOUTH SIDE OF <br />HARTFORD STREET BET~FEEN PACIFIC AVENUE AND CA~4BRIDGE AVE~UJE. <br />(UP-76-5) ~ <br /> <br /> WHEREAS~ Union Oil of California has made an <br />application pursuant to Section 40-70(b) of the Code of <br />the City of Portsmouthf Virginia, 1973, for the granting of <br />a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director <br />have done all things required to be done in connection with <br />said application and the Planning Conu~ission has recommended <br />the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED bp the Council of <br />the City of Portsmouth~ Virginia: <br /> <br /> (a) That the use for which the use permit here- <br />inafter described is sought (1) will not adversely affect <br />the health or safety of persons residing or working in the <br />neighborhood of the proposed use, (2) will not be detrimental <br />to the public welfare or injurious to property or improve- <br />ments in the neighborhood~ and (3) will be in accord with <br />the purposes of the Zoning Chapter of the City Code. <br /> <br /> (b) The City of Portsmouth is hereby granting a <br />use permit pursuant to Section 40-70(b) of the City Code to <br />operate an automotive service station on the property describ- <br />ed as follows: <br /> <br /> Beginning at the southwest corner of <br />Hartford and Cambridge Streets; thence run- <br />ning south along the west side of Cambridge <br />Strset 125 feet; thence west 100 feet to a <br />point; thence north 125 feet to the south- <br />side of Hartford Street; thence east along <br />Hartford Street 100 feet to the point of <br />beginning. <br /> <br /> (~) That the granting of this use permit is subject <br />to the following condition: <br /> <br /> A site plan be prepared acceptable to the City of <br />Portsmouth's Traffic Engineer in terms of access to public <br />streets and such site plans indicating compliance with all <br />other City Code provisions. <br /> <br /> <br />
