A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPE-RTY BY THE~CtTY OF PO~TS~IOUTH, VIRGINIA, UNDER~ ~IINENT DOI~iAIN~PRO- CEEDINGS, PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSE~4BLY, AS A~.~ED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, OPERATIONAND MAINTENANCE OF THE TWIN PINES RECREATION ARE~. WHEREAS, the-City of Portsmouth has found it necessary to acquire the interest hereinafter specif.ied in and to the here- inafter described parcel of' land situate in the City of Ports- mouth, Virginia~ for the purpose of constructing, operating and maintaining the Twin Pines. Recreation Area; and ¥-ETEREAS, the City of Portsmouth has not been able to purchase the property herein~'described, necessary to the project; because the owners thereof and the City have not be~n able to agree upon' the price to be paid therefor~ and WHEREAS, advancement of the work and use will be delayed unreasonably if said property is not made avail~ able as soon ~as possible. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia; That the City Attorney be, and he hereby is, directed to institute eminent domain proceedings against the followimg des- cribed property situate in the City of Portsmouth, Virginia, f~r the purpose of acquiring fee simple title therein, together' with any and all easements of access~ light or air incid?nt to the lands of the landowner abutting upon said property, zn ac- cordance with and pursuant to Section 2.06, 2.07 and 2.08 of the Charter of the City of'Portsmouth, Virginia (Chapter 471 of the Acts of Assembly, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of Ports- mouth as provided by law the sum hereinafter specified to com- pensate the owner of the hereinafter~described parcel of land. All those cer'tain lots, pieces or parcels of land, situate, lying and being in the City'of Portsmouth, Virginia, With the buildings and im- ~provements thereon~ known, numbered and designated as Lots 4 and 5, Block 2, as shov~ on the plat of Churchland Land Company, recorded in the Clerk's office of the Circuit Court of the City of Chesa- peake, Virginia, in Map Book 18, page 85~ of said project The name of the property owners are Harvey L. McCoy and Ethel Mae McCoy.
