~5 <br /> <br />A RESOLUTICk~ GRANTING A USE PERMIT TO ROBERT ANDERSON TO OPERATE A <br />~ AT 7~O YORFIfOWN AVENUE. <br /> <br /> ~_~{EAS, Rot~_rt Anderson made an application pursuant %o Section <br />40-69(b) of ~ Code of the City of Portsmouth, 1973, for the granting <br />of a use permit as hereinafter .described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />things required to be done in connection with saidapplzcation;' ' and <br /> <br /> WHEREAS,' the Planning Cc~mission has r~ded the granting of <br />said use permit. <br /> <br /> NOW, ~ORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That the use for which the use p~mit hereinafter described is <br />sought; <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or ~njurious to <br />property' or improv~nents in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter <br />of the City Code. <br /> <br /> 2. Robert Anderson is hereby granted a use permit pursuant to <br />Section 40-69(b) of the City Code to operate a junkyard on the propert~~ <br />described as follows: <br /> <br /> Beginning on the west side of Yorktown Avenue approxi- <br />mately 121 feet south from its intersecf~on with County Street; <br />thence south 151.88 feet to a point; thence northwest 283.24 <br />feet; thence southwest 29.72 feet; thence north 89.60 feet; <br />thence east 300 feet to the eas~ right of way line of Yorktown <br />Avenue, the Point of Origin. <br /> <br /> 3. The issuance of this use permit is conditioned upon Mr~ Anderson <br />operating a service garage, wrecker service, dismantling used automobiles, <br />the storing of salvaged parts in a garage and disposing of the remains <br />of the autc~obile. <br /> <br /> (a) He is not to shear automobile. He is not to store <br />autc~obile skeletons permanently on his property. <br /> <br /> (b) Off-street p~rking spaces will be protrided sufficient <br />for all vehicles operated by the enterpirse, plus one space for each <br />five ~-d~loyses coP~puted on the r ~ ~ · <br /> g ea~es~ number of persop~ to be employed <br />at ~ny one period during the day or night as required by City Ord~ia~nce. <br /> <br /> <br />
