~ ~ TY A RESoLuTIoN TO PROVIDE FOR THE ACQUISITION DF CERTAIN PROPER BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EM~INENT DOMAIN~PR~- CEEDINGS, PURSUANT TO C}~PTER 471 OF THE ACTS OF~ ASSEMBL~, ~AS A~4ENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, OPERATIONAND MAINTE~'~ANCE OFTHE TWIN PINES RECREATION AREA. ' ~'~EREAS, the City of Portsmouth has found it ne~cessary to' acquire the interest hereinafter, specified in and to the.-here- inafter described parcel of land situate in the Cityof Ports- mouth, Virginia for the purpose o~f constructing, operating and maintaining the. Twin Pines Recreation Area; and .~ ~HEREJ~S, the ~City of PortsmoUth~ has not been able..to'p~rchase [- the property herein-described, necessary to. the project',~ because ~ 'the owners thereof and the City have not been able to agree upqn the price to be paid therefor; and -WHEREAS, advancer~ent of the work and use of said pro~ec~ will be delayed unreasonably if said property is not made avail- able as soon as possible. . -. NOW, THEREFORE., BE IT RESOLVED by the Council of the City of Portsmouth, Virginia; That the City Attorney be, ~nd he h~reby is, directed to institute eminent domain proceedings a~alnst the~ following des- Cribed property situate in the City of. Portsmouth, Virginia, for the purpose of acquiring fee simple title therein, .together with any and all.easements of access, light or air incident to the lands of the landowner abutting upon said property, in ac- cordance with and pursuant to Section 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia (Chapter 471 of the Acts of Assembly, as amended), and to deposit'to'the credit of the Clerk of the Circuit Court of the City of~Ports- · mouth as provided by law the sum hereinafter specified to com- pensate the owner of the hereinafter described parcel of land. Ail that certain lot[ piece or parcel of land, situate, lying and being in the City of Portsmouth, Virginia, with the buildings and im- provements thereon, known, numbered and desig- nated as Lot I1, Block 2, as sho~ on the plat of Churchland Land company, recorded in the Clerk's Office of the Circuit Court of the. City of'Chesapeake, Virginia; in ~4ap Book 18, page 85. The name of the property owners are George H. Walker and Irene B. Walker.
