4 <br /> <br />A RESOLUTION VACATING A DRAINAGE ~ (ELMHURST LANE, MANOR VIEW, <br />SECTION 6). <br /> <br /> WHEREAS, by eas~n~nt agreement dated October 27, 1970, Amelia G. <br />McLean and George T. McLean, her husband, conveyed to the City of Ports- <br />mouth an ~t agreement under add across the following described <br />property, to-wit: ~ <br /> <br /> Beginning at a point on the northwest oorner of <br /> Yorkskire Road and Elr0hurst Lane; thence bXD5o31'12" <br /> ease along the western right-of-way of Elmherst Lane <br /> extended a distance of 1,585.42 feet to-the true point <br /> of beginning; thence N84°28'48" west 137.75 feet to a <br /> point on the rear property line of Manor View, Section <br /> 2; thence N05°31'12" east 15 feet to a point; thence <br /> S84O28'48'' east 137.75 feet to a point on the western <br /> -right-of-way of Elmhurst Lane extended; thence S05°31'12" <br /> west 15.00 feet along said right-of-way to the True Point <br /> of Beginning. <br /> <br /> WHEREAS, the fee simple owners of the property on which said eas~e_nt <br /> was granted have caused said property to be subdivided .into lots; and <br /> WHEREAS, due to the configuration of said subdivision lots, it is <br /> necessary to relocate the previously granted easement; and <br /> <br /> WHEREAS, the subdivision plat to be reoorded by the property owners <br /> describes a new eas~aent to be dedicated to the City for installation and <br /> maintenance of drainage pipes and lines, and the same ~has been approved by <br /> the Engineering Department. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of PortsmDuth, <br /> Virginia, that the easement dedicated by agre~aent dated OcbDber 27, 1970 <br /> from Amelia G. F~Lean and George T. McLean, her husband, recorded in the <br /> Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in <br /> Deed Book 561, Page 438, be, and the same hereby is, v~cated. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, <br /> authorized to execute such deeds of release and doctmaents as may .be-neeessa~y <br /> to convey the interest of the City in the hereinabove described property. <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meet- <br /> ing held January 10, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
