86 A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER- EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS AM~NDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTIONw MAINTENANCE AND OPERATION OF PORT FACILITIES. WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafter specified in and to the hereinafter described parcel of land, situate in the City of Portsmouth, Virginia, for the purpose of constructing, operating and maintaining port facilities; and WHEREAS, the City of Portsmouth has not been able to purchase the property described herein, necessary to the project, because the owner thereof and the City have not been able to agree upon the price to be paid therefor; smd WHEREAS, advancement of the work and the property will be delayed unreasonably if said not made available as soon as possible. use of said property is NOW, THEREFOREr BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Attorney be, and he hereby is~ directed to institute eminent domain proceedings against the following described property, situate in the City of Portsmouth~ Virginia, for the purpose of ac- quiring fee simple title thereto, together with any and all easements of access, liqht or air incident to the lands of the landowner abutting upon said property in accordance with and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly, 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of Portsmouth as provided by law the sum hereinafter specified to compensate the owner of the parcel of land described as follows, to-wit: Ail those certain lots, pieces or parcels of land, situate in the City of Portsmouth, Virginia, known, numbered and designated as Lot 10~ on the plat of Pinners Point Land CQmpa~yz recorded in the Clerk's Office of the Circuit Court of the City of~ Chesapeake, Virginia, · n Map Book 4, Page 7.
