59 A RESOLUTION GRANTING A USE PERMIT TO MARY STEWART, EVANGELIST, TO OPERATE A HOUSE OF WORSHIP PURSUANT TO SECTION 40-71(b) O~ THE CODE OF THE CITY OF PORTSMOUTH~ VIRGINIA. WHEREAS~ Morse Parker Motor Supply, Inc., by Mary Stewart, Evangelist~ made an application pursuant to Section 40-71(b) of the Code of the City of Portsmouth~ Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said applicantion; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW~ THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (1) sought: That the use for which the use permit hereinafter is (a) Will not adversely affect the health or safety of persons residing or working in the neighborhood of the pro- posed use; (b) injurious to and Will not be detrimental to the public use or the property or improvements in the neighborhood; (c) Will be in accord with the purposes of the Zoning Chapter of the City of Code. {2) Mary Stewart, Evangelist, is hereby granted the use permit pursuant to Section 40-71(b) of the Code of the City of Portsmouth, Virginia, to operate a House of Worship at the property described as follows: Begznning on the west side of Effingham Street approximately 140' south of its inter- section with High Street; thence south along Effingham Street approximately 16'; thence west approximately 68'; thence north approxi- mately 16'; thence east approximately 68' to Effingham Street, the Point of Origin. (3) This use permit is approved subject to the following conditions.
