58 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO THE SALVATION A~4Y <br />TO OPEP~ATE A HOUSE OF WORSHIP PURSUANT TO SECTION 40-7!(h) <br />OF THE CITY CODE NEAR THE INTERSECTION OF WESTERN BRANCH <br />BOULEVARD AND HALIFAX AVENUE. <br /> <br /> WHEREAS, R. Coleman Morgan, by John E. Davis, Cormuanding <br />Officer of the Salvation Army, made application pursuant to <br />Section 40-71[b) of the Code of the City of Portsmouth, Vir- <br />ginia, 1973, for the granting of a use permit as hereinafter <br />described; and <br /> <br /> WHEREAS, the applicant and the Planning Director' have <br /> done all things required to be done in connection with said <br /> application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br /> granting of said use pel~uit. <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED by the Council of the <br /> City of Portsmouth, Virginia: <br /> <br /> fl) That the use for which the use permit hereinafter <br /> is sought: <br /> <br /> [a~ Will not adversely affect the health and <br /> safety of persons residing or working in the neighborhood <br /> of the p~oposed use; <br /> <br /> ~b~ Will not be detrimental to the public use <br /> or injurious to property or improvements in the neighborhood; <br /> and ~ ~3 <br /> <br /> (c} Will be in accord with the purposes of the <br /> Zoning Chapter of the City Code. <br /> <br /> ~) The Salvation A~my is hereby granted a use permit <br />pursuant to Section 40-71 ~} of the Code of the City of <br />~'Portsraouth, ~i~ginia, to operate a House of Worship at the <br /> property described as follows: <br /> <br /> Beginning on the south side of Western <br /> Branch Boulevard~ 60 feet ~ast of its inter- <br /> section with Halifax Avenue; thence east 60 <br /> feet along Western Branch Boulevard; thence <br /> south to the north right-of-way of King Street; <br /> thence west 60 feet; thence north to the south <br /> right-of-way of Western Branch Boulevard, the <br /> Point of'Origin. <br /> <br /> <br />
