42 A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH REDEVELOP- MENT AND HOUSING AUTHORITY TO OPERATE A DAY CARE CENTER FACILITY PURSUANT TO SECTION 40-78~b) OF THE CITY CODE. WHEREAS, Portsmouth Redevelopment And Housing Authority, made an application, pursuant to Section 40-78(b) of the City Code of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Commission has recommended the grant- ing of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: sought: That the use for which the u§e permit hereinafter is (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the pro- posed use; (b) Will not be detrimental to the publ~ ~S~ 'o~ in- jurious to the property or improvements in t.he neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. Portsmouth Redevelopment And Housing Authority is hereby granted a use permit pursuant to Section 40-78(b) of the City Code to operate a day care center facility at the property described as follows: In the Community Center at the Ida Barbour Publio Housing Park, said Center is on the east side of Barbour Drive, ap- proximately 245 feet north from its inter- section of So~th Street~ having an address of 1104 Barbour Drive. 3. This use permit is approved subject to the following conditions: (a) The facility will be operated from 8:30 A.M. to 3:00 (b) The facility will begin operation with twenty-six children under six (6) years of age; and this may rise to forty (40) children.
