A RESOLUTION GRANTING A USE PERMIT TO MARIE WILSON HARRIS TO OPERATE A DAY CARE CENTER PURSUANT TO SECTION 40-78 (b)~ WHEREAS, Marie Wilson Harris~ made an application pursuant to Section 40-78(b) of the Code of the City of Portsmouth, Vir- ginia, 1973, for the granting of a use pe_~mit as hereinafter- described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended %he granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of ~Ile City of Portsmouth, Virginia: 1. That the use for which the use ~ermit hereinafter is sought: (a) Wilt not adversely affect the health ~nd safety of persons residing or working iD the neighborhood of ~he pro- posed use~ (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of t~e Zoning Chapter of the City Code. 2. Marie Wilson Harris is hereby granted a use permit pur- suant to Section 40-78(b) of the City Code to operate R day care center at the property described as follows~ Beginning on the west side of Elm Avenue approximately 87 feet south from its intersection with Ann Street; thence west 105 feet~ thence south 58 feet; thence east 105 feet to the west right-of-way of Elm Avenue; thence north 58 feet along said right-of-way to the point of origin~ 3. This use permit is approved subject to the conditions: (a) That there not be more than ten under six (6) years of age enrolled at ~ny one facility as it exists today; following (10) children time in the
