82 A RESOIDTION GRA~ING AN ~/~ND~ENT TO A USE P~MIT ~OR ~HE OPERATION OF A NURSING H(IME AT THE NORTHEAST COP~ER OF RODMAt~ ~VENUE AND ~FiNCY~'I'~ DRIVE. ~KAREAS, AngeI1 Group, Inc., made an application purSuant to Section 40-75(b) of the Code of the City of Poz~cs/routh~ Virginiar 1973, for an amer~J~ent of a use permit issued by City Council on February 26, 1963, to Pauline ti. Barfield on the sole issue of transfer of ownerskip; and I*~EPdlAS, the applic&nt and %he Planning Director have done all things required %o be done in connection with said appliCation..- and ~%.r~E?~AS~ the Planning Cc~/nission has rended %he 9ranhir~ of the amendment to said use permit. NOW, RITEREFORE, BE IT RESOLVED by %he Council of %he Ci.t.y of Portsmouth, Virginia: 1. R'nat the use for which %he use permit hereinafter is sought: (a) Will not adversely affec~ the heai%h and safely of persons residing or working in %he neighborhood of the proposed use; O~) Will not be detrimental ~o the public use or injurious to the property or .hnprov~ents in the neighborhood; ~d (c) Will be in accord with the purposes of the Zoning Chapter of the City Code° 2. Angell Group, Inc. is hereby granted a use permit pursuant %o Section 40-75(b) of %he City Code %o operate a nursing home at %he property described as follows: Beginning at the northeast intersection of Winchester Drive and Rodman Avenue; thence north along ~he east side of Rodman Avenue to %he south right-of-~ay of Arlington Place; %hence east along said right-of-way 90'; thence south 108.5'; thence east 180'; thence north 108.5' to ~he south right of-way of ~rlington Place; %hence east along said right-of-way to %he west right-of-way of Halifax Auenue; thence south along said right-of-~ray to .the no~h right-of-way of Winchester Drive; thence west along said right-of-way %o Rodman Avenue, %he point of origin.
