34 <br /> <br />A RESOLUTION .GRANTING A USE PERMIT TO YLARIE WILSON PiAI~RIS TO <br />OPEP~ATE A DAY CARE CENTER PURSUANT TO SECTION 40-78 (b). <br /> <br /> ¥~{EREAS, the Council of the City of Portsmouth, Virginia, <br />qranted a use permit to Marie Wilson Harris to operate a day <br />care center pursuant to Section 40-78(b) on May 8, 1979; and <br /> WHEREAS, Marie Wilson Harris has made an application <br />pursuant to said section for the amendment of said use permit <br />to allo~ additional children to be enrolled in the facility; and <br /> ~K~E_RF~.AS~ t~e applicant and the Plan~ng Director ~have ~one <br />all t{~in~s required i~ be done in connection with said appli- <br />cation; and <br /> WHEREAS, the Planning Commission has recommended the granting <br /> of said use permit. <br /> NOW, THEREFORE, BE iT RESOLVED by the Council of the City <br /> of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter is <br /> sought: <br /> (a) will not adversely affect the health and safety <br /> ~esld~ng or <br /> of persons ~ · ~ ~orking in the neighborhood of the proposed <br /> use; <br /> (b) Will not be detrimental to the public use or in- <br /> juriou~ to the ~roperty or improvements in the neighborhood; and <br /> (c) Will be in accord with the purposes of the Zoning <br /> Chapter of the City Code. <br /> 2. Marie Wilson .Harris is hereby granted ~..use permit <br /> purMuant ~to Section 40-~78(b) of the C~ty Code to operate a <br /> day care center at the property described as follows: <br /> Beginning on the west side of Elm <br /> Avenue approximately 87 feet south from <br /> its intersection with Ann Street; thence <br /> west 105 feet; thence south 58 feet; thence <br /> east 105 feet to the west right-of-way of <br /> Elm Avenue; ~hence north 58 feet along said <br /> right-of-way to the Ooint of origin. <br /> <br /> 3.
