5 A RESOIfJTION GRAN'±'ING A, USE PERMIT %0 MR. AND _MRS. TH~iAS Bo VIZ~ASCO TO OPERATE A PRIVATE RESID~CE AND HOME FOR THE ELDERLY NEAR THE t~±~SECTt(~ OF UTAH STR~±' AND KINGMAN AVENUE. WHEREAS, ~r. and ~rs. Thomas B. Velasco, made an application pursuant to Section 40-75(b), Code of the City of Portsmouth, Virginia, 1973, for the granting of a use pe~uit as hereinafter-described; and I~TEt~EAS, the applicants and the Planning Director have done all ~hings required to be done in connection with said application; and ¥.~SRIEAS, the Planning Con~ssion has re~ded the granting of said use permit. NC~q, T~IEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: sought: That the use for which the use permit hereinafter-described is (a) Will not adversely affect the health and safety of persons residing and workina in thenelgbborhoodof' the proposed use; (b) Will not be detrimental to the public use or injurious to property and improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City_ Code. 2. That Mr. ~d Mrs. Thomas B. Valasco are hereby granted a use permit pursuant to Section 40-750a), Code of the City of Portsmouth, 1973, to operate a private residence and home for the elderly on property hereinafter-described: Beginning at the northeast corner of Utah Street and Turnpike Road; thence no~--~herly along Utah Street 175 feet; thence easterly 200 feet; thenee southerly 175 feet to Turnpike Road; thence wesnerly 200 feet to U~/a Street; the Point of Origin. Also known as 3736 Turnpike Road. 3. This use pemnnit is approved subject to the following conditions: (1) No more than nine (9) elderly female guests shall ~e in the convalescent and nursing home.
