96 <br /> <br />A RESOLUTION~AUTHORIZING THE CITY k4ANAGER TO CONVEY PORTIONS <br />OF THE FO~ER SF~ABOARD COAST LINER AILWAY COMPANY R!GHT~OF- <br />WAY TO PORTSMOUTH REDEVELOPFLENT AND HOUSING _AUTHORITY. <br /> <br /> WHEREAS, by deed dated NoVember 27, 1978, recorded in <br />the Clerk's Office of the Circuit Court of the City of <br />Portsmouth, Virginia, in Deed Book 750, Page 353; the City <br />of Portsmouth purchased the abandoned right-of-way of Seaboard <br />Coast Line Railway Company extending fromthe Western Branch <br />of the Elizabeth River to Mount Vernon Avenue; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />determined that certain portions of the property thus purchased <br />are required for improvement of streets, public utilities, <br />and for other public purposes.; and <br /> <br /> WILEREAS, the remainder of the property thus purchased <br />is no longer required for public purposes and is hereby declared <br />to be excess; and <br /> <br /> BVHEREAS, Portsmouth Redevelopment 'And Housing Authority <br />was established to acquire property and to encourage the re- <br />development and reuse of sUch property by making same available <br />to private enterprise for development; and <br /> <br /> WHEREAS, pursuant to ~2.O9 (c) of the Charter of the City <br />of Portsmouth,. Virginia, the City may convey real property <br />to the Commonwealth of Virginia or a political subdivision <br />thereof without public advertisement; and ~' <br /> <br />WHEREAS,'Portsmouth Redevelopment & Housing Authority <br />political subdivision of the Commonwealth of Virginia. <br /> <br /> NOW. THEREFORE, BE IT RESOLVED by the Counci!'~f the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is, authorized to conyey portions of the former Seaboard <br />Coast Line Railway Company right-of-way to Portsmouth Redevelop- <br />ment & Housing Authority for the purpose of disposing of said <br />excess property. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to execute such deeds and other documents <br />as may be necessary to complete said transactions. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held December 9, 1980. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
